Bmeaningful Social Media Contest Rules- Companies and Causes Conference

OFFICIAL BMEANINGFUL SOCIAL MEDIA CONTEST RULES

 

NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN THIS CONTEST.

OPEN ONLY TO LEGAL RESIDENTS OF CANADA, EXCLUDING QUEBEC, WHO ARE AT LEAST 18 YEARS OLD AS OF THE DATE OF ENTRY.

By entering this contest, (the “Contest”) entrants accept and agree to be bound by these Official Rules. Any violation of these rules may result in disqualification. All decisions of Bmeaningful regarding this Contest are final and binding in all respects.

 

1. CONTEST PERIOD. Contest begins September 11, 2017 at 9:00AM Eastern time (“ET”) and ends September 17, 2017 at 11:59 PM ET (the “Entry Period”).

 

2. ELIGIBILITY. This Contest is only open to legal residents of Canada, excluding Quebec, who are at least 18 years old as of the date of entry. Employees, officers, directors, of Bmeaningful, the Sponsor, or any other party associated with the development or administration of this Contest, and their immediate family (i.e., parents, children, siblings, spouse) are not eligible. It is also void outside Canada and where prohibited (for example, in Quebec). Entrants agree to be bound by the terms of these Official Rules.

You also must be a fan of the Bmeaningful Facebook page and be subscribed to our newsletter at the time of the Contest in order to win one free ticket to the 2017 Companies and Causes Canada Conference.

3. HOW TO ENTER. During the Entry Period, post a comment sharing your favourite company or cause on Twitter @B_meaningful or Facebook @Bmeaningful and include the hashtag #LoveBCause.

Below are the two ways to enter the Contest during the Contest Period:

1. Facebook: To enter the Contest, You must (i) have a valid Facebook account and logon to Facebook (ii) share a comment on Bmeaningful’s Facebook page www.facebook.com/bmeaningful listing your favourite company or cause ; and (iii) hashtag #LoveBCause
2. Twitter: To enter the Contest via Twitter, you must (i) logon to twitter with a valid, public Twitter account (not protected); (ii) publish a tweet that tags Bmeaningful’s Twitter Account by including @B_meaningful in the tweet sharing your favourite company or cause; and (iii) hashtag #LoveBCause

The Bmeaningful Contest Post includes a hyperlink to these official Rules to signify that you have read and agree to be bound by these Rules.

Each platform you publish or post a comment with the hashtag #LoveBCause you receive one (1) Contest Entry, (the Entry) for a chance to win the prize. You are limited to one comment per platform. For clarity purpose, if you publish or post a comment with the hashtag (#LoveBCause) on Facebook and Twitter you are entered twice. If you comment two times on Facebook sharing your favourite company or cause with the hashtag #LoveBCause you will only be entered once.

For the purposes of this Contest, the entrant is the person who is the holder of the Facebook, or Twitter account(s) submitted. It is to this individual that the prize will be awarded if selected and declared as the winner.

By entering this contest, entrants give their expressed permission to be contacted by Bmeaningful via Facebook, Twitter, and/or email, and gives Bmeaningful the rights to reuse, repurpose, and repost their comment. Bmeaningful or its designated representatives can post her/his name and photo/image regarding the Contest on any of Bmeaningful’s Social Media channels without any form of remuneration. Submission of a comment indicates agreement with the Official Bmeaningful Contest Rules.

4. WINNER SELECTION; NOTIFICATION. A draw for the Contest will take place and one (1) winner will be randomly drawn from all eligible entries received during the Contest Period. Bmeaningful shall select one Winner on September 18, 2017. The decision of Bmeaningful is final. The odds of winning a prize depends upon the number of eligible entries received. The Prize must be accepted as awarded, cannot be substituted, transferred, exchanged, deferred or surrendered for cash.

The potential Winner will be notified by direct message via the social media channel used and instructed on how to claim her/his prize. To be declared a Winner, each entrant must:

1. correctly answer a time-limited, mathematical skill-testing question without assistance administered by a Bmeaningful representative by telephone at a mutually convenient time.
2. sign and return a standard form of Declaration of Release prepared by Bmeaningful within five (5) business days from the date on which the form is sent to the potential winner. If the potential winner fails to return a completed Declaration and Release to Bmeaningful within the deadline, such potential Winner shall be deemed to have automatically forfeited her/his right to claim the Prize, and Bmeaningful shall have the right to select another potential winner(s).

The entrant must otherwise comply with these official contest rules.

Awarding of a prize is subject to verification and compliance with these official contest rules. Entrants who have not complied with these official contest rules will be disqualified. If a selected entrant cannot be located or does not respond or comply with all of these official contest rules within twenty four (24) hours of notification, the entrant will be disqualified and forfeits the Contest prize and Bmeaningful may, at its sole and absolute discretion, select by random draw another eligible entrant whom Bmeaningful or its representatives will attempt to contact, and who will be subject to disqualification, in the same manner.  If there is no response by the deadline, Bmeaningful will continue the above process until a winner is confirmed. Upon contacting a potential winner and determining that he/she has met all eligibility requirements of the Contest, including without limitation the execution of required waivers, publicity and liability releases and disclaimers, such individual will be declared the official “Winner” of the Contest. The winner may be required to provide their full name, mailing address, and age.

Allow two to three weeks from the date of the draw for verification of contest winner and prize fulfillment. Each winner will be contacted following verification with details on how to redeem the prize. Bmeaningful will not be responsible for failed attempts to notify selected entrants.

If a potential or declared winner is not in compliance with the Official Rules, then Bmeaningful reserves the right to disqualify such entrant from the Contest and randomly select further entrants from the remaining eligible entries until an official Winner is finally declared.  Entrants will not be individually contacted, except for selected entrants or potential or declared winners.

 

The official Winner may be announced on www.facebook.com/bmeaningful and/or in our newsletter. Bmeaningful will post the Winner’s name. Any individual who, at the sole determination of Bmeaingful, abuses the entry process in any way will be disqualified. Bmeaningful is not responsible for lost, late, incomplete, invalid, unintelligible or misdirected entries, which will be disqualified.

 

5. PRIZE DESCRIPTION. One (1) Winner will receive access to a free ticket to the 2017 Companies and Causes Canada Conference valued at $545 before tax. Bmeaningful is not responsible for lost, stolen or misdirected delivery of the ticket. Bmeaningful is not responsible for any transportation costs related to the Conference or any additional costs you may have associated with your ticket acquisition process.

6. TAXES. All federal, provincial and/or local income and other taxes, if any, are the winner’s sole responsibility.

 

7. OWNERSHIP AND LICENSE. All entry materials (“Submission”) become the property of Bmeaningful and will not be acknowledged or returned, except the creator shall be credited as such if the comment is used by Bmeaningful in any publication or dissemination to the public. The copyright in any Submission shall remain the property of the entrant, but entry into this Contest constitutes entrant’s irrevocable and perpetual permission and consent, without further compensation or attribution, to use, reproduce, print, publish, transmit, distribute, sell, perform, adapt, enhance, or display such Submission for any purpose, including but not limited to editorial, advertising, trade, commercial, and publicity purposes by Bmeaningful and/or others authorized by Bmeaningful, in any and all media now in existence or hereinafter created, throughout the world, for the duration or the copyright in the Submission. Entrant hereby warrants and represents that the Submission is original and does not infringe upon any third party copyright or trademark or right of privacy and anyone depicted in the Submission has provided his/her consent for his/her identifiable image to be included in the Submission.  Bmeaningful and/or others authorized by Bmeaingful shall have the right to edit, adapt, and modify the Submission.

 

8. NO PRIZE TRANSFER OR SUBSTITUTION. No substitutions for prize. The Prize must be accepted as awarded, cannot be substituted, transferred, assigned, exchanged or surrendered for cash or deferred for another year.

8. PUBLICITY : By accepting the prize, the winner authorizes Bmeaningful, or its designated representative(s) to use the winner’s name, photograph, or image or any declaration on the Contest for the purpose of publicity, and this, without any form of compensation. The winner further authorizes Bmeaningful to post this information up to twelve (12) months after the Contest end date.

9. ADDITIONAL CONDITIONS OF PARTICIPATION. By participating in this Contest, each entrant accepts and agrees to these official contest rules and all decisions of the contest judges (who may be employees, agents or independent contractors of Bmeaningful), which shall be final and legally binding on entrant in all matters relating to this Contest. All entries become the property of Bmeaningful and will not be returned. ANYONE DEEMED BY THE SPONSOR TO BE IN VIOLATION OF THESE RULES FOR ANY REASON IS SUBJECT TO DISQUALIFICAION IN THE SOLE AND ABSOLUTE DISCRETION OF THE SPONSOR AT ANY TIME. In order to be confirmed a winner and receive a prize, each selected entrant will be required to sign Bmeaningful’s form of Declaration of Compliance and Release which confirms compliance with these official contest rules and releases Bmeaningful and its affiliated companies, agencies, contest prize suppliers, and their respective officers, directors, employees and agents (collectively, “Bmeaningful Entities”) from all liability with respect to the entrant’s participation in this Contest and the awarding and use of the prize. By entering the Contest, each entrant releases and discharges Bmeaningful Entities from any and all liability whatsoever in connection with this Contest and/or acceptance, possession and/or use of prizes, including without limitation legal claims, costs, injuries, losses or damages, demands or actions of any kind (including without limitation personal injuries, damage to, loss or destruction or property, rights of publicity or privacy, defamation, or portrayal in a false light) (collectively, “Claims”).

The winner agrees to the use of his/her name, comments, photograph, and other likeness for publicity purposes, and grants to Bmeaningful any and all rights to said use without further compensation. Bmeaningful Entities are not responsible for printing, distribution, or production errors. Bmeaningful Entities may, at their sole discretion and without liability, rescind or amend this Contest at any time.

10. LIMITATION OF LIABILITY. By entering this Contest, each entrant acknowledges and agrees that Bmeaningful Entities: (i) shall have no liability of any kind whatsoever with respect to this Contest and/or the awarding or use of the prize, (ii) makes no warranty, guaranty or representation of any kind concerning the prize, (iii) disclaims any implied warranty, and (iv) is not liable for injury, loss or damage of any kind resulting from the entrant’s acceptance or use of the prize or otherwise from such entrant’s participation in this Contest. Bmeaningful Entities is not responsible for typographical or other errors in the offer or administration of this Contest, including, but not limited to, errors in advertising, the official contest rules, the selection and announcement of winners, or the distribution of the prizes. Bmeaningful Entities is not responsible for any problems or technical malfunctions of any telephone network or lines, computer online systems or servers, computer software problems or traffic congestion on the internet or at any website and assumes no liability for damage to entrant’s or any person’s computer resulting from participating in the Contest.

By entering this Contest, you: (a) agree to remise, release and forever discharge the Contest Sponsors, their respective parent and affiliated companies, any and all other companies associated with the Contest (including prize suppliers and suppliers of materials or services related to the Contest), and all of their respective employees, directors, officers, shareholders, agents, representatives, successors and assigns (collectively, the “Releasees”) from any and all actions, causes of action, suits, debts, dues, accounts, claims, damages or liability for any loss, harm, damages, costs or expenses, including, without limitation, costs or losses related to personal injuries, death, damage to, loss or destruction of property, and rights of publicity, personality, privacy and/or intellectual property (each, a “Claim”) arising out of, or in any way related to, your participation in the Contest and/or the awarding, receipt, possession, use and/or misuse of any Contest prize (or any portion thereof), or any travel or activity that is related to the receipt or use of any Contest prize; and (b) agree to indemnify and hold harmless each of the Releasees from and against any and all Claims arising from (i) your breach of these Official Rules, including the breach of any representations or warranties contained herein, (ii) your participation in the Contest, (iii) your acceptance, possession, use and/or misuse of any Contest prize (or any portion thereof), if applicable, or (iv) the use of any Entry Material in accordance with the rights granted in these Official Rules.

 

10. DISCLAIMERS. (i) Entries that are lost, late, misdirected, incorrect, garbled, or incompletely received, for any reason, including by reason of hardware, software, browser, or network failure, malfunction, congestion, or incompatibility at Bmeaningful’s servers or on Bmeaningful’s  Facebook page at www.facebook.com/Bmeaningful or elsewhere, will not be eligible. In the event of a dispute, entries will be deemed submitted by the authorized account holder of the e-mail address submitted at the time of entry. “Authorized account holder” is defined as the natural person who is assigned to an e-mail address by an Internet access provider, online service provider, or other organization (e.g., business, educational institute) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address; (ii) Bmeaningful, in its sole discretion, reserves the right to disqualify any person tampering with the entry process or the operation of the Bmeaningful’s web site or the Bmeaningful Facebook page. Use of bots or other automated process to enter is prohibited and may result in disqualification at the sole discretion of Bmeaningful; (iii) Bmeaningful further reserves the right to cancel, terminate or modify the Contest if it is not capable of completion as planned, including by reason of infection by computer virus, bugs, tampering, unauthorized intervention, force majeure or technical failures of any sort; (iv) Bmeaningful Entities are not responsible for errors in the administration or fulfillment of this Contest and prize, including without limitation mechanical, human, printing, distribution or production errors, and may modify or cancel this Contest based upon such error at its sole discretion without liability. (v)

BMEANINGFUL ENTITIES MAKE NO WARRANTIES, REPRESENTATIONS OR GUARANTEES, EXPRESS OR IMPLIED, IN FACT OR IN LAW, AS REGARDS THIS CONTEST OR THE MERCHANTABILITY, QUALITY OR FITNESS FOR A PARTICULAR PURPOSE REGARDING ANY PRIZE OR ANY COMPONENT OF ANY PRIZE.

(vi) CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE THE BMEANINGFUL WEBSITE OR FACEBOOK PAGE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS CONTEST MAY BE A VIOLATION OF CRIMINAL AND/OR CIVIL LAWS, AND SHOULD SUCH AN ATTEMPT BE MADE, BMEANINGFUL RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING WITHOUT LIMITATION ATTORNEYS’ FEES) FROM ANY SUCH ENTRANT TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION.

 

11. APPLICABLE LAWS AND JURISDICTION. This Contest is subject to all applicable federal, provincial, and local laws and regulations. Issues concerning the construction, validity, interpretation and enforceability of these Official Rules shall be governed by the laws of the province of Ontario. All disputes arising out of or connected with this Contest will be resolved individually, and without resort to class action, exclusively by a provincial or federal court located in Toronto, Ontario. Should there be a conflict between the laws of the province on Ontario and any other laws, the conflict will be resolved in favour of the laws of the province of Ontario. All judgments or awards shall be limited to actual out-of-pocket damages (excluding attorneys’ fees) associated with participation in this Contest and shall not include any indirect, punitive, incidental and/or consequential damages.

 

12. Bmeaningful. This Contest is run by Bmeaningful, and is not affiliated with Facebook or Twitter. This Contest is in no way sponsored, endorsed or administered by, or associated with, Facebook or Twitter.

13. PERSONAL INFORMATION. The personal information gathered about entrants in the course of this Contest will be used solely by Bmeaningful for the administration of the Contest and in connection with publicity relating to the Contest and in accordance with the Sponsor’s privacy policy (available at www.aeroplan.com/PrivacyPolicy).
